Dylan McGrath wins 7-Day Licence case

Masterchef Dylan McGrath’s €1.4 million new restaurant, Fade Street Social, has been granted a Full 7-Day Publican’s Licence by the Circuit Civil Court.

A Declaratory Order was granted in respect of the premises pursuant to Section15 of the Intoxicating Liquor Act 1960 in July 2010 by the Dublin Circuit Court. The Gardai and the Fire Officer were the only parties to respond to that application which was approved by the Court.

There were two further applications to amend the plans that were before the Court, mandated by planning considerations. Judge Matthew Deery found that the Court had jurisdictions to make the amendments to the plans as sought.

An objection to the grant of the Certificate pursuant to Section 17 of the Intoxicating Liquor Act 1960 had been lodged by publicans in the area but Judge Matthew Deery found that the premises had been constructed substantially in accordance with the plans and it would be unreasonable in the present circumstances not to grant the licence.

He was satisfied that the premises would be run in the manner as outlined during the course of Dylan McGrath’s evidence to the Court and granted the licence.
